BP Settlement

Immediately as it got established, several people residing in those affected areas of the Gulf Coast states when this spillage happened have already been given their compensation. Kenneth Feinberg, who is the BP compensations fund’s chief, in December 2010 iterated that to those affected by the oil spill and do not intend to file a law suit against BP can apply for the BP Settlement instead.

What have been the BP Settlement claims so far?

Till date there are 496,114 claims that are filed by those people who wanted to ultimately receive a huge share of the BP Settlement and strongly get all the damages caused to them compensated. Around $3.5 billion was in all paid to about 170,709 individuals and businesses. However, not all the BP Settlement claims have been completely accepted. If at all the claims that you have made to BP have been rejected then do not worry as there is still hope. There is another chance wherein you could still have the claim that you put forward re-filed or re-assessed or just be a part of those who have filed the lawsuit. There are hundreds and hundreds of lawsuits already filed against BP, smacking a $376 million bucks for the compensatory pays. This is separate from the BP compensations funds that were created.

If at all you are one of those who has lost a lot of property, business, other financial losses due to the Gulf Oil Rig exposure then contact the BP attorneys as they will determine if at all you are eligible for the BP Settlement of claims or not.

GCCF News

According to GCCF, these are some the latest facts and figures as of late December, 2011 :

* $170 Million paid on 10,575 claims to Florida Keys residents and businesses, even as no oil has actually reached the area
* $2.5 Billion paid on 210,235 claims to Florida residents and businesses, mostly in Panhandle counties
* $357 Million paid to 12,300 Louisiana fishermen, 80% of which came in the form of quick final payouts averaging $29,000 ($5,000 for individuals, $25,000 for businesses), higher than the average compensation throughout the entire program
* 5.4 Billion total paid out as of October 2011, a little more than a year after the oil spill

Inconsistent payouts even among claimants with similar situations is another point of contention, along with improper document handling, undue delays in processing claims, and lowball offers, all legitimate concerns that prompted calls for a BP GCCF audit. In June, Congressman Jon Bonner met with Attorney General Eric Holder, asking the Justice Department to conduct an independent review of the claims process, with determinatiom methods and GCCF personnel qualifications as possible areas that should be looked into.

BP Business Claims

States of Alabama, Florida, and Louisiana are provided with advance funding for easier processing of the BP Claims. The claims of government are given priority because it is the government which assisted in reducing the impact of the damage caused by this spill. The claims by government include the response and removal of oil cost, cost of increased public services, and for the loss in revenue due to the disruption of its businesses.

BP claims for individuals is the most disputed area in this compensation process. More than 40,000 claims have been rejected by the Gulf Coast Claims Facility for not producing required documents. Kenneth Feinberg, who was praised for his administration of 9/11 victims fund, is the chairman of GCCF. Feinberg is criticized for the lack of transparency in calculation and distribution of funds. Many argue that if the claims are calculated in GCCF method, the amount due is less than what the claimant is eligible for.
